Penalties for Domestic Violence Charges

Domestic violence charges can carry serious consequences. Also referred to as domestic battery, it is considered a misdemeanor in California. If you have been accused of domestic violence, you could be facing probation, up to a year in jail, thousands of dollars in fines, and other penalties. The court may also decide to issue a protective order against you to protect the alleged victim from having contact with you. If you violate this order, you be dealing with increased penalties. This order can be made effective for up to 10 years.

CA Penal Code 243(e)(1) directly lays out the laws regarding domestic battery, also known as domestic violence. Battery itself is defined in Penal Code 242, when a domestic relationship is involved in the crime, it becomes a crime under Penal Code 243(e)(1). Domestic battery is defined as a willful, unlawful touching that is harmful or offensive, committed against a spouse/partner, child, fiancé, cohabitant, relative, or any other intimate or domestic relationship.
